Near Miss of the Day 738: Near Pass driver claims he was a ‘racing cyclist’ – but is fined £100

A driver who narrowly passed a cyclist told police he always drove carefully around cyclists, despite video evidence to the contrary, and claimed he himself had been a ‘racing cyclist’ and that he had been knocked off his bicycle while riding in the same location.

The driver of the Transit van had made what reader James described as a ‘super close pass’ – and despite various excuses in his defence, he was fined £100 and his driver’s license drive was approved with three penalty points.

“Interestingly, the officer handling him sent me a copy of an email the driver sent him outlining various mitigations for the pass,” James told us. .

“The officer wanted to know if I wanted him to continue with the FPN given the mitigation. Here are some of the driver’s comments from that correspondence. [with James’s observations afterwards]:

As an experienced cyclist myself, I have raced and been on a few teams and ridden in many countries over a 40 year period. I am a very patient and caring driver when it comes to cyclists at all times.

“As evidenced by passing when approaching traffic lights and a roundabout, and in oncoming traffic.”

I myself have been faced with many situations with close overtaking for many years as a cyclist. I had two major accidents on this same road.

“Yet he still opted to move to a spot where his offside wheels barely crossed the halfway line.”

I’m in no way saying that I don’t have responsibilities as a general road user, but I feel a fine and points are a bit unfair.

“Maybe he should think about why this happened?”

James added: “Suffice it to say that once I reviewed the footage to make sure I hadn’t misremembered, I requested that they proceed with FPN.”
